In addition to www.g-w.com, the term "Website" shall also include any other websites, web pages, mobile applications and mobile Websites operated by G-W.

This privacy policy (together with any documents referred to herein, collectively this "Privacy Policy") applies to you ("you" or "your" or "yours") and your use of the Website including, without limitation, any content, functionality or services offered on or through the Website, whether as a guest or as a registered user.   For the purposes of this Privacy Policy, G-W provides our customers the following "Services" either directly or through our technology partners: G-W Online Textbook Platform; Online Learning Suite ("OLS"); Online Instructor Resources ("OIR"); G-W EduHub Powered by D2L Brightspace; G-W EduHub LMS-Ready Content; G-W Ignite and G-W eCommerce.  Our Services are generally performed for our customers who are educational institutions or directly for the benefit of students located in the United States.

This Privacy Policy describes how we collect, use, process, store, share and dispose of your personal information, including any Personally Identifiable Information ("PII") used to access this Website, or provided to us in connection with the Services we perform for you or your educational institution. PII is any information that can be used to identify, locate, or contact you or that can be used to distinguish or trace an individual’s identity, either alone or when combined with other information, such as Student Information described below, that is linked or linkable to a specific individual. It also includes other information that may be associated with your name or other identifying characteristics. 

We will not use or share your personal information with any third party except as described in this Privacy Policy. Our use of personal information collected through our Websites and as we perform Services shall be solely limited to the purposes described in this Privacy Policy. 

2.  PRIVACY POLICY CONSENT

By using the Website or agreeing to allow us to perform Services for you or your educational institution, you accept and agree to be bound and abide by this Privacy Policy and our Terms of Use (available at https://www.g-w.com/terms) which is incorporated as a part of this Privacy Policy by this reference. If you do not want to agree to this Privacy Policy, you must not use the Website, and we will not be able to enter into an order with you to perform Services. 

All personal information we collect on this Website or through the Services is subject to our Privacy Policy. By using the Website or entering into a Services order with G-W, you consent to all actions taken by us with respect to your personal information in compliance with this Privacy Policy.

We will not sell or rent your personal information to anyone. 

5.  STUDENT INFORMATION

We may collect certain legally protected information from or about students, such as students’ personally identifiable information, in the course of providing our Services ("Student Information"). In general, we consider Student Information to be confidential and do not use such Student Information for any purpose other than to provide and improve the Services on behalf of our users and customers. Our collection, use and sharing of Student Information is governed by federal, state and local laws, as applicable, and not by any conflicting provisions contained in this Privacy Policy. This Privacy Policy does not supersede the terms of any agreements between us and any other party.

 

We may also act as a "school official" under the United States Family Educational Rights and Privacy Act, 20 U.S.C. 1232g, 34 CFR Part 99 ("FERPA"). As a result, G-W may receive, from educational institutions, Student Information that constitutes all or portions of a student’s education record. Student Information that G-W receives from education records will be used only for the purposes for which the disclosure was made. G-W may combine information it receives from educational institutions with other personal information collected by or through this Website. 

If you have any questions about reviewing, modifying, or deleting Student Information provided to us by your school or educational institution, please contact your school or educational institution directly.

6.  OTHER PERSONAL INFORMATION AND USES

Other Data Collection and Use

G-W collects and uses your Internet activity and related information to operate its Website(s) and deliver the Services you have requested. G-W may also use this Internet and other network activity information to inform users of other products or services available.  

Tracking User Behavior

G-W may keep track of the Website(s) and page(s) our users visit within www.g-w.com to determine which services and content are the most popular. This data is used to deliver more content where our customers’ behavior indicates that they are interested in a subject area. 

Automatically Collected Information

Information about your computer hardware and software may be automatically collected by G-W. This information can include your: IP address, browser type, website addresses, pages viewed, domain names, geographical location, access times and referring website addresses. This information is used for the operation of the Website, to maintain the quality of the Website, and to provide general statistics regarding use of the Website. 

Use of "Cookies"

Like many commercial websites, we use standard "cookie" technology and web server logs to collect information about how our Website and Services are used. Cookies are small pieces of data that are stored by your web browser on your hard drive. Cookies allow our web servers to recognize the computers used to access our Website and Services. Cookies allow you to move from page to page within our Website and Services by remembering the information about the entire session.

Information gathered through cookies and by our web server logs may include your IP address, the date and time of your visit, the pages viewed, time spent on our Website and Services, and the websites visited immediately before and after using our Website and Services. We do not sell your personal information to third parties for money -- no one can buy the personal information we collect from and about you and we do not act as a data broker. However, we may need to share your personal information with other users, third parties, and service providers to make the Website and the Services operate. This section otherwise explains when and why we share your information. 

Primarily, G-W only collects, processes, uses and stores personal information for the express and limited purpose of performing the Services for an educational institution, student or individual in question.

We will use the information provided to us to respond to your requests, fulfill your orders, contact you with information that you have requested, or otherwise for purposes as outlined in this Privacy Policy, including:

  • To facilitate and enable the registration, access, and operation of the Services;
  • To respond to your requests for product support or customer service;
  • To personalize your use of and experience with the Services; and
  • To monitor and improve the overall performance and quality of the Services. 

G-W’s Service Providers 

We rely on third-party service providers to support or provide services for us in connection with your use of the Services, such as communications and hosting, security and fraud prevention, technical and customer support, tracking and reporting usage of the Services, quality assurance testing, payment processing, marketing, and other functions. We share information from or about you with these third party providers so that they can perform their services or complete your requests. We share personal information with our service providers subject to obligations consistent with this Privacy Policy, and on the condition that personal information is only used on G-W’s behalf and pursuant to our instructions. Our third party service providers may likewise share information with us that they obtain from or about you in connection with providing their services or completing your requests.

G-W’s role as a Service Provider 

G-W collects, receives and processes certain information about you on behalf of businesses for which we are acting as a service provider. We do not share information collected or received by us outside of our role as a service provider with the business or other third parties, unless otherwise disclosed in this Privacy Policy, or at your direction. Third parties may also share information about you with us in order for G-W to provide services to them.  Third parties’ collection, use and disclosure of your information is subject to such third party’s own privacy policy and any relevant terms.

E-mail Communications

From time to time, G-W may contact you by e-mail for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication related to your use of the Services. In order to improve our Services, we may receive a notification when you open an e-mail from G-W or click on a link therein. 

Student Information

User information and user-generated content may also be made available to school officials, including instructors, who G-W reasonably believes to have a legitimate educational interest in such information and materials. Such information and materials may include a student's first and last name, username, e-mail address, student ID (if provided), the student's substantive course work, any student recorded and submitted communications, uploaded documents, product usage information (including time on site, time spent on each course-related activity, submission dates and times for course activities), score and grade information, login history, account creation date and time, and enrollment history.  Additionally, if we make chat rooms, forums, or message boards available by or through the Services, it is important to remember that information you choose to disclose in these areas may be viewed, accessed, retained, or re-disclosed by other users of the Services. We encourage you to exercise caution in deciding whether to disclose your personal information on such forums.

Process Payments

We will use your personal information as necessary to process your payment for the purchase of products or Services from us. 

Targeted Advertisements

We may use information related to your purchase at the Website to communicate with you about new promotions and products and Services that we believe may be of interest to you. We may use Internet and other network activity information that has been aggregated by social media platforms to run social media advertisements and promotional campaigns. 

For the avoidance of doubt, G-W will not provide any third party with any personal information for purposes of engaging in targeted advertising. However, we may disclose aggregated user information or statistics in order to describe the Services to prospective partners, advertisers, and other third parties, and for other lawful business purposes.

We may allow third-party companies to collect Internet and other information for purposes of serving targeted advertisements. These companies may use information (e.g., click stream information, browser type, time and date, subject of advertisements clicked or scrolled over) collected during your visits to this and other websites, or in connection with your use of the Website, in order to provide advertisements about goods and services likely to be of interest to you. These companies typically use a cookie or third-party web beacon to collect this information. These third-party companies who utilize these cookies or beacons on our websites enable you to opt-out of this behavioral advertising. Business Transfers

If another company acquires G-W, or all or substantially all our assets, that company will possess the same information, and will collect, use, and disclose the information only as described in this Privacy Policy.

Investigations and Legal Disclosures 

We may investigate and disclose information from or about you if we have a good faith belief that such investigation or disclosure: (a) is reasonably necessary to comply with legal or law enforcement processes, such as a search warrant, subpoena, statute, judicial proceeding, or other legal process or law enforcement request; (b) is helpful to prevent, investigate, or identify possible wrongdoing in connection with the Services; or (c) protects our rights, reputation, property, or that of our users, affiliates, or the public. the contributor of that content in order to provide an opportunity for the contributor to respond.

The Services may link to third party-controlled websites, like a business’s URL. Except as set forth herein, we do not share your personal information with them, and are not responsible for their privacy practices.

8.  HOW WE SHARE THE INFORMATION WE COLLECT

We may share your personal information with third parties such as our e-newsletter provider in order to contact you via e-mail, our merchant accounts to process payments, Google/social media accounts in order to run advertisements, and our affiliates. We require that the third parties with which we share personal information use the information only for purposes that it was shared, maintain the security and confidentiality of the personal information, and have in place reasonable administrative, physical, and technical safeguards to protect the personal information. Such third parties are not permitted to share your personal information with other entities, and are not permitted to use the personal information for their own purposes other than providing services to us. 

Viewing by Others

Note that whenever you voluntarily make your personal information available for viewing by others online through this Website, the Services or its content, your personal information may be seen, collected and used by others, and therefore, we cannot be responsible for any unauthorized or improper use of this personal information that you voluntarily share (i.e., sharing a comment on a blog post, posting in a Facebook group that we manage, etc.). 

Submission and Storage of Personal Information

Personal information that you provide to us is stored internally or through an external data management system. Your personal information will only be accessed by our personnel who obtain, manage or store that personal information, or who have a legitimate need to know such personal information (i.e., our hosting providers, e-newsletters, payment processors or team members). 

G-W does not sell, rent or lease its customer lists to third parties.

Other than Student Information provided to us by your school or educational institution, which is handled as described in Section 5 (Student Information), or as required by law, you may opt-out or request us to delete your personal information at any time by contacting us at ciso@g-w.com, or as otherwise described below in Sections 15 and 16. You can do the following at any time by contacting us via the e-mail address above: 

  • See what personal information we have about you, if any.
  • Change/correct any personal information we have about you.
  • Have us delete any personal information we have about you.
  • Express any concern you have about our use of your personal information.

If you choose not to provide us with certain personal information, you may not be able to participate in or access certain aspects of our Website, Services, or content. 

Unsubscribe

You may unsubscribe from our e-newsletters or updates at any time through the unsubscribe link at the footer of all e-mail communications. If you have questions or are experiencing problems unsubscribing, please contact ciso@g-w.com

Do Not Track

Except as otherwise permitted under Section 7 (Targeted Advertisements), G-W does not track user personal information over time and across websites. G-W does not allow third parties to collect user personal information for purposes of tracking over time or across websites. G-W does not receive or honor browser do not track signals. 

10.  YOUR CALIFORNIA PRIVACY RIGHTS

If you are a California consumer, you have the following rights under the California Consumer Privacy Act ("CCPA") and the California Privacy Rights Act ("CPRA"): 

  1. Right to Know. You can ask us to give you information about our collection and use of your personal information. Specifically, you can request that we provide you one or more of the following:

If you do not receive a confirmation of our receipt of your request within 10 business days, we may not have received your request and you should re-submit it. Once we receive your request, we will attempt to verify your identity. We may ask you for additional information to help us verify your identity, including by asking you to confirm other personal information you have provided to us. We may deny your request for reasons permitted by law, including our inability to verify your identity. If we deny your request, we will tell you why we did so.

Subject to certain restrictions, you can have an agent exercise your rights for you. If you have an agent exercising your rights, that person must provide to us your written authorization allowing them to make such a request on your behalf. We reserve the right to deny the agent’s request if we are not reasonably able to confirm proper authorization and/or verify your identity as the requestor.

Sensitive Personal Information

When we collect financial details (such as your bank account or credit card numbers), we are deemed to be collecting data that is "sensitive" under state privacy laws. Where legally required, we will obtain your consent for collecting this information. For our California users, we do not use or disclose sensitive personal information for any purpose other than as permitted by law, such as to provide our Service to you, to detect security incidents, and protect against malicious or fraudulent actions, nor do we use or disclose such information to build a profile about you.  

Retention

We retain your personal information as long as it is necessary to provide you our Service and to comply with our data retention requirements.  Even after you stop using our Service, we may be required to keep your information for as long as necessary to comply with our legal and regulatory obligations, to make or defend legal claims, and to protect against fraudulent activity of others.

Global Privacy Control ("GPC") is a setting you can enable in your web browser to communicate your privacy preference for not having certain information about your webpage visits collected across websites. Subject to certain limitations, you have the rights listed above in Section 11 under CCPA and CPRA.

12.  SECURITY OF YOUR PERSONALLY IDENTIFIABLE INFORMATION

We use various safeguards to protect the personal information submitted to us, both during transmission and after we receive it.  Specifically, G-W secures your personal information from accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access by using industry standard security measures such as encrypting data in transit with HTTPS, Secure Sockets Layer ("SSL") Protocol, and SFTP while data at rest is encrypted by AES-256 algorithms and the AWS key management infrastructure through AWS Key Management Service, when your personal information is being processed systems hosted by Amazon Web Services.

When personal information (such as a credit card number) is transmitted to our third-party payments processors’ websites, this data is always inaccessible to G-W and is protected using encryption, such as the SSL and TLS protocols. 

We strive to take appropriate security measures to protect against accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to personal information that is transmitted, stored or otherwise processed by G-W.  However, no method of transmission over the Internet or via mobile device, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.  

We may store your personal information on servers provided by third party hosting vendors or other infrastructure service providers, and we regularly enter into contracts with such third parties that require such service providers to provide adequate security safeguards compatible with the requirements and obligations we agree to adopt with our customers.  We require that our service providers deploy no less than a reasonable level of security, taking into account the state of the art, the costs of implementation and the nature, scope, context and purposes of processing as well as the risk of varying likelihood and severity for the rights and freedoms of natural persons. 

13.  INFORMATION FROM OR ABOUT CHILDREN

Our Website is generally not intended for children. No one under age 13 may directly provide any personal information to or on the Website. We do not knowingly collect personal information from children under 13. If you are under 13, please do not register on the Website, make any purchases through the Website or send any information about yourself to us, including your name, address, telephone number or e-mail address. If we learn that we have collected personal information from a child under age 13, we will promptly delete that information. Some features of our Website or Services may allow children under the age of 18 to provide personal information and/or interact with the Website or the Services. For any feature of the Website or the Service available through the Website that allows children under the age of 18 to provide PII, we will rely on verifiable parental consent obtained through our school district customers as the basis for collecting such personal information. 

We encourage parents and teachers to spend time online with children and to monitor their online activities. Please protect your child's privacy by instructing them to never provide personal information via the internet without your permission.

14.  OTHER IMPORTANT PROVISIONS

Data Retention

We retain your information for as long as necessary to provide you and our other users the Services. This means we keep your profile information for as long as you maintain an account. We retain transactional information for at least seven years to ensure we can perform legitimate business functions, such as accounting for tax obligations. We also retain your information as necessary to comply with our legal obligations, resolve disputes and enforce our terms and policies. If you request account deletion, we will delete your information as set forth in the "Deleting Your Account" section below. 

Deleting Your Account

If you would like to delete your G-W account, please contact our privacy team ciso@g-w.com. In some cases, we will be unable to delete your account, such as if there is an issue with your account related to trust, safety, or fraud. When we delete your account, we may retain certain information for legitimate business purposes or to comply with legal or regulatory obligations. For example, we may retain your information as part of an open legal claim. When we retain such data, we do so in ways designed to prevent its use for other purposes. 

Confidentiality

We aim to keep your information confidential. Please note that we may disclose such information if required to do so by law or in the good-faith belief that: (1) such action is necessary to protect and defend our rights or property or those of our users or licensees, (2) to act as immediately necessary in order to protect the personal safety or rights of our users or the public, or (3) to investigate or respond to any real or perceived violation of this Privacy Policy or of our Terms of Use, or any other terms of use or agreement with us. 

International Visitors

G-W is headquartered in the United States, and we offer goods and services to consumers in the United States. We have operations and vendors in the United States and other countries. Therefore, we and those that perform work for us may transfer your personal information to, or store or access it in, jurisdictions that may not provide levels of data protection that are equivalent to those of your home jurisdiction.  We would only transfer personal information outside of the United States based on your consent, to fulfill our contractual or other legal requirements, or for the legitimate business needs of G-W.
